History

Richmond Residents for Responsible Antenna Placement and Planning (RAP) is a grass-roots coalition of individual residents and neighborhood organizations working to prevent the placement of wireless antennas on or near residences, schools, day care centers, playgrounds and other inappropriate locations in the City of Richmond.  We want to work with the City of Richmond and the telecommunications companies to secure cell sites that are to the benefit of all parties and to enforce our own city codes.  We want to revise our current codes to remove any questionable areas that allow for exemptions and loopholes to be used in secret without public scrutiny.  We want to make sure that the City of Richmond maximizes antenna placement as an income revenue source for Richmond and that all antennas are monitored regularly by the telecommunications companies operating them for acceptable EMF emissions.

The call to action leading to the creation of RAP was the recent discovery of a new cellular antenna site (with high powered antennas) installed at 260 Water Street by T-Mobile and local real estate agents Gerald and Janice Feagley.  It is almost in operation, on top of an apartment building in the middle of a residentially zoned area directly across from the bedroom windows of residents.  This site was approved by one planner without any Planning Commission review or public comment and in violation of numerous sections of the existing city ordinance.  We have been denied an appeal of what we believe to be a violation of our procedural due process and right to be noticed.  Additionally we believe that other improper actions were taken by the City and that they are in violation of the California Environmental Quality Act.  The city has not followed procedure, has denied the rights of Richmond residents and is potentially creating a situation of great harm to the environment and human health.  This installation must be stopped before setting a dangerous precedent.

This petition asks:

1.
260 Water Street project to be stopped and that T-Mobile and the building owners, Gerald and Janice Feagley, be required to apply for a Conditional Use Permit or remove the structure.  Additionally that a California Environmental Quality Act review must take place.
2.
For an immediate 90 day moratorium on all new cellular and PCS antennas in the City of Richmond, while the City, RAP and any other interested Richmond citizens work out a strategy to resolve the issues, per the FCC guidelines set forth for this type of situation.  The said moratorium is to be extended in 90 day increments until agreement is reached.
3.
The City of Richmond Planning Department must inventory their records to provide a map and listing of all existing installations for proper assessment of safety and code compliance.  This is also necessary when dealing with the telecommunications companies regarding need of further installations and for tracking income to the city from these installations.
